Tenderfoot Adventures Membership Agreement & Liability Waiver.
Welcome to Tenderfoot Adventures.
We believe that the outdoors has the power to improve lives, build friendships, restore perspective, and inspire a lifelong spirit of discovery. Our goal is to provide safe, well-organized, and memorable outdoor experiences while fostering a welcoming community built on kindness, respect, and adventure.
By becoming a member and participating in Tenderfoot Adventures activities, you acknowledge that you have read, understood, and agree to the following Membership Agreement and Liability Waiver.
1. Membership Agreement
As a member of Tenderfoot Adventures, I agree to:
Treat fellow members, guides, volunteers, and the public with courtesy, kindness, and respect.
Help create a welcoming, inclusive, and encouraging environment for participants of all experience levels.
Respect public lands, private property, wildlife, and the natural environment by practicing Leave No Trace principles.
Participate within my own physical abilities and exercise good judgment regarding my health and fitness.
Follow the instructions of Tenderfoot Adventures guides and event leaders.
Notify an event leader if I choose to leave an activity early or separate from the group.
Conduct myself in a manner that reflects positively on the Tenderfoot Adventures community.
Tenderfoot Adventures reserves the right to suspend or terminate membership for conduct that jeopardizes the safety, enjoyment, or well-being of other participants.
3. Personal Responsibility
I certify that I am physically capable of participating in the activities for which I register.
I agree to:
· Bring appropriate clothing and equipment.
· Carry sufficient food and water.
· Take responsibility for managing my own health conditions.
· Inform the event leader of any concerns that could affect my safety.
· Make responsible decisions throughout each activity.
I understand that Tenderfoot Adventures may refuse participation if safety concerns exist.
4. Emergency Medical Care
In the event of an emergency, I authorize Tenderfoot Adventures, its guides, volunteers, or representatives to obtain emergency medical treatment on my behalf if I am unable to make those decisions myself.
I understand that I am responsible for all medical costs incurred.
5. Release of Liability
To the fullest extent permitted by applicable law, I voluntarily release and hold harmless Tenderfoot Adventures, its owners, guides, assistants, volunteers, contractors, sponsors, business partners, and event leaders from claims arising out of or related to my participation in Tenderfoot Adventures activities, except to the extent such claims cannot legally be waived under applicable law.
This release applies to activities conducted on public lands, private lands, roadways, waterways, businesses, lodging facilities, transportation services, and other locations associated with Tenderfoot Adventures programs.
9. Cancellation and Refund Policies
I understand that event cancellations, membership refunds, and travel cancellations are governed by the current Tenderfoot Adventures policies published on the official website.
10. Severability
If any provision of this Agreement is determined to be unenforceable, the remaining provisions shall remain in full force and effect.
11. Acknowledgment
By checking the agreement box or signing electronically, I acknowledge that:
· I have carefully read this Membership Agreement & Liability Waiver.
· I understand its contents.
· I understand that I am giving up certain legal rights as permitted by applicable law.
· I voluntarily agree to its terms.
· I understand that this Agreement applies to my participation in Tenderfoot Adventures activities unless replaced or updated by a subsequent agreement.
2. Assumption of Risk
I understand that outdoor recreation involves inherent risks that cannot be completely eliminated.
Activities offered by Tenderfoot Adventures may include, but are not limited to:
· Hiking
· Walking
· Backpacking
· Snowshoeing
· Cycling
· Kayaking
· Photography outings
· Cultural excursions
· Domestic and international travel
· Educational programs
· Social events
I understand these activities may involve hazards, including, but not limited to:
· Uneven terrain
· Rocks, roots, mud, snow, and ice
· Steep slopes and cliffs
· Falling rocks or tree limbs
· Wildlife encounters
· Insects and plants
· Heat, cold, rain, wind, lightning, smoke, and rapidly changing weather
· Water crossings
· Vehicle transportation
· Remote locations
· Delayed emergency response
· Equipment failure
· Physical exertion
· The actions or negligence of other participants
I voluntarily choose to participate knowing these risks exist.
6. Transportation
I understand that some activities may include ridesharing or transportation arranged between participants.
Tenderfoot Adventures does not guarantee or control privately owned vehicles operated by participants.
I voluntarily assume any risks associated with such transportation arrangements.
7. Photography & Media
Tenderfoot Adventures frequently photographs and records activities for educational, promotional, historical, and marketing purposes.
Unless I notify Tenderfoot Adventures in writing that I prefer not to appear in identifiable photographs or videos, I grant permission for photographs or videos in which I appear to be used in newsletters, social media, printed materials, websites, presentations, and promotional publications without compensation.
8. Membership Communications
By becoming a member, I consent to receive communications regarding:
· Event registrations
· Weather updates
· Schedule changes
· Membership renewals
· Newsletters
· Travel announcements
· Safety information
I understand that I may unsubscribe from non-essential marketing communications at any time.
